Halle Berry: Oscar Winner’s Ex-Husband Oliver Martinez Scores Major Legal Victory in Bitter Custody Battle of Their Son
Olivier Martinez, Halle Berry’s ex-husband, has secured a major legal victory amid their ongoing custody dispute. Martinez was granted primary physical custody of his and Halle Berry’s 13-year-old son, Maceo, while a judge also ruled that Berry can no longer have overnight visits with him, according to TMZ.”
A representative for Berry told the website that the actress still shares the joint legal custody of Maceo and has the final say if she and Martinez cannot agree on a decision regarding their child. The judge also rejected Martinez’s request for a domestic violence restraining order that would have covered both him and their son, according to a Page Six report.

“We are extremely pleased that the Court has dissolved the TRO,” Marina Beck, Berry’s attorney, told Page Six. “As we move forward, Halle is determined to continue to focus on the well-being and best interests of her family.”
Earlier this month, Martinez, 60, secured a temporary domestic violence restraining order against Berry after alleging in court documents that she had “physically abus[ed]” their 13-year-old son, Maceo, “by jumping on him and choking him” during an incident on September 26. Berry has denied the allegations.
The latest development follows a courtroom clash between attorneys for Berry and Martinez two days earlier, as their custody dispute over their son, Maceo, continued.
During the hearing at Los Angeles Superior Court, Martinez’s attorney, Patrick Baghdaserians, asked Judge Shelley Kaufman to reopen the evidence so he could question Berry, 60, about an Instagram post she shared on Monday, according to a Page Six reporter who attended the hearing.
Baghdaserians reportedly accused Berry of breaching the terms of a temporary domestic violence restraining order.
Berry’s attorney, Marina Beck, pushed back against the request, describing the attempt to question her client as a “last-minute grasp at straws” and “nothing more than a witch hunt,” the publication reported.
The dispute centered on a repost Berry shared to her Instagram Stories on Monday. The post has since disappeared.
It featured a quote attributed to relationship coach Kai Vinci, who wrote: “If kids disrespect their mom, the root cause often traces back to their relationship with the father.. [100 emoji].”
Nothing Settled
Responding to the request to reopen questioning, Beck reportedly accused Martinez’s legal team of seeking to “just intended to re-open evidence and continue their false narrative.” She also alleged that Baghdaserians intentionally made the request in open court to ensure reporters would witness it.
Martinez’s lawyer denied that accusation, saying the request was not dependent on reporters being present, according to Page Six. Baghdaserians argued that Berry’s Instagram post had appeared shortly after the presentation of evidence had concluded.
“This sort of conduct is the reason we are here today,” Martinez’s attorney said, alleging that Berry’s post had “disturbing my client’s peace” and “calm.”
Judge Kaufman ultimately rejected the request to reopen the evidence.
Page Six reported that the courtroom was cleared after the attorneys’ exchange, allowing Berry and Martinez’s legal teams to present their closing arguments.
According to a minute order reviewed by The Daily Mail, Martinez had also faced questioning from attorneys representing both sides on Oct. 23.
Berry’s fiancé, musician Van Hunt, 56, was also questioned by her legal team. Hunt was at the property during the incident involving Berry and her son. After Hunt testified, Martinez’s attorneys sought to recall Maceo “as a rebuttal witness and to present his testimony remotely,” the minute order stated.
However, Martinez’s legal team withdrew the request after the court ruled that any further testimony from Maceo would have to be given in person.
